SHIPPING TERMS & CONDITIONS AGREEMENT

1. ACCEPTANCE OF TERMS

By using our shipping services and/or accepting a receipt for shipping services, you ("Customer") agree to be bound by these Shipping Terms and Conditions ("Agreement"). This Agreement governs all shipping services provided by The Corner Post ("Company," "we," "us," or "our").

2. SCOPE OF SERVICES

2.1 Service Description

We provide shipping intermediary services, including:

  • Package acceptance and preparation

  • Carrier rate comparison and selection

  • Label creation and application

  • Package tender to carriers (USPS, FedEx, UPS)

  • Basic tracking information provision

  • Claims assistance (as defined below)

2.2 Service Limitations

We do NOT provide:

  • Transportation or delivery services

  • Package insurance (available separately through carriers or third parties)

  • Guarantees of delivery times, methods, or success

  • Liability coverage beyond our facility

3. LIABILITY AND RISK TRANSFER

3.1 Transfer of Liability

CRITICAL PROVISION: Our liability for your package ends immediately when:

  • The package is accepted by the selected carrier (USPS, FedEx, or UPS), AND

  • The package leaves our physical facility

3.2 Carrier Responsibility

Upon transfer to the carrier:

  • Selected carrier assumes full liability for package

  • All delivery guarantees, insurance, and claims become carrier responsibility

  • Customer must pursue claims directly with the carrier for loss, damage, or delay

3.3 Our Liability Limitations

Company liability is limited to:

  • Maximum of shipping fees paid to us (not including carrier charges)

  • Services performed within our facility only

  • No liability for consequential, incidental, or indirect damages

  • No liability for package contents, value, or delivery performance

4. CARRIER SERVICES

4.1 Authorized Carriers

We work with the following carriers:

  • United States Postal Service (USPS)

  • FedEx Corporation

  • United Parcel Service (UPS)

4.2 Carrier Terms

Each carrier has its own terms and conditions that apply to your shipment once accepted. Customer is responsible for understanding and agreeing to carrier terms.

4.3 Carrier Selection

  • Customer selects carrier and service level

  • We provide rate comparisons but do not guarantee accuracy

  • Customer is responsible for appropriateness of selected service

5. INSURANCE AND DECLARED VALUE

5.1 Insurance Options

Insurance coverage is available through:

  • Carrier-provided insurance/declared value coverage

  • Third-party insurance providers

  • Customer's own insurance policies

5.2 Insurance Responsibility

  • Customer is responsible for purchasing insurance if desired

  • We provide information only - not insurance advice

  • Claims must be filed directly with insurance provider

  • We are not liable for uninsured packages

6. PROHIBITED ITEMS

6.1 Restricted Items

We cannot accept packages containing:

  • Hazardous materials as defined by DOT regulations

  • Illegal substances or contraband

  • Perishable items without proper packaging

  • Items prohibited by carrier policies

  • Firearms, ammunition, or weapons

  • Live animals or plants

  • Items exceeding carrier size/weight limitations

6.2 Customer Warranties

Customer warrants that packages contain only legal, non-prohibited items and comply with all applicable laws and carrier restrictions.

7. PACKAGE HANDLING

7.1 Package Acceptance

  • We inspect packages for obvious damage or leaks

  • Customer responsible for proper packaging and labeling

  • We may refuse inadequately packaged items

  • Special handling requirements must be disclosed

7.2 Package Preparation

  • We may repackage items for shipping compliance

  • Additional fees may apply for repackaging

  • Customer approves any additional services and fees

  • Original packaging materials may not be returned

8. CLAIMS ASSISTANCE

8.1 Our Claims Support

We will assist customers with:

  • Providing shipping documentation for claims

  • Explaining carrier claim procedures

  • Facilitating communication with carriers

  • Providing transaction records and receipts

8.2 Claims Limitations

We do NOT:

  • Guarantee successful claim outcomes

  • Provide legal advice or representation

  • Assume liability for carrier claim decisions

  • Compensate for carrier claim delays or denials

8.3 Customer Claim Responsibilities

Customer must:

  • Report problems within carrier-specified timeframes

  • Provide all requested documentation

  • Cooperate with carrier investigation procedures

  • Pursue claims directly with carriers when required

9. PRICING AND PAYMENT

9.1 Service Fees

  • Shipping fees include our service charges plus carrier rates

  • Prices subject to change without notice

  • Additional fees may apply for special services

  • All fees due at time of service

9.2 Payment Terms

  • Payment required before package acceptance

  • We accept cash, credit cards, and checks (with ID)

  • Returned check fees apply

  • No refunds after package transfer to carrier

10. CUSTOMER RESPONSIBILITIES

10.1 Accurate Information

Customer must provide:

  • Accurate recipient and sender addresses

  • Correct contact information

  • Accurate package contents description

  • Appropriate service level selection

10.2 Compliance

Customer is responsible for:

  • Compliance with all applicable laws

  • Proper packaging and labeling

  • Understanding carrier restrictions

  • Timely payment of all fees

11. LIMITATION OF LIABILITY

11.1 Maximum Liability

Our total liability for any claim is limited to the lesser of:

  • The shipping service fees paid to us (excluding carrier charges)

  • $100 per package

  • The actual documented loss (if less than above)

11.2 Excluded Damages

We are not liable for:

  • Consequential, incidental, or punitive damages

  • Lost profits or business interruption

  • Damage to reputation or goodwill

  • Delays in delivery or service

  • Carrier performance issues

11.2 Indemnification

Customer agrees to indemnify and hold harmless The Corner Post, its employees, and agents from any claims, damages, or expenses arising from:

  • Customer's violation of these terms

  • Customer's shipment of prohibited items

  • Inaccurate information provided by customer

  • Customer's failure to comply with applicable laws

12. DISPUTE RESOLUTION

13.1 Governing Law

This Agreement is governed by the laws of [Your State], without regard to conflict of law principles.

12.2 Dispute Resolution Process

  1. Direct Communication: Disputes should first be addressed directly with management

  2. Mediation: If unresolved, disputes may be submitted to mediation

  3. Arbitration: Binding arbitration may be required for disputes over $500

  4. Jurisdiction: Any legal proceedings must be filed in Gallatin County, Montana

13. GENERAL PROVISIONS

13.1 Agreement Modification

  • This Agreement may be updated at any time

  • Changes effective upon posting to our website

  • Continued use constitutes acceptance of changes

13.2 Severability

If any provision is deemed unenforceable, the remainder of the Agreement remains in effect.

13.3 Force Majeure

We are not liable for delays or failures due to circumstances beyond our control, including natural disasters, carrier service disruptions, or government actions.

ACKNOWLEDGMENT

By using our shipping services, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions. This Agreement constitutes the entire agreement between you and The Corner Post regarding shipping services.
